The Buying Process...
Let's find your place to call home! In this folder: San Francisco Neighborhood Map General information for Buyers and Sellers Disclosures & Disclaimers Advisory House Tour checklist
Sample purchase agreement & docs...
This is the SF Purchase Agreement and supporting documents that reflect the terms we will discuss. This is an example for your review (based on a purchase price of $1.5m)...I have highlighted the most important parts for your convenience below. I look forward to chatting with you about the process. Item # The purchase price is based on neighborhood comparables (sales over the past 6 months), location, condition of the property, floor plan, amenities and current pending sales. 1A. The Initial Deposit is your earnest deposit to open escrow and it is delivered by wire to the Title Company within 2 business days of offer acceptance. It is 3% of your purchase price and down payment. *Wire fraud is real...you must call the Title Co. and speak to a representative to confirm the wire instructions before transferring your funds.** 1C. This is the loan amount. The interest rate and terms are confirmed by the lender. 1E. If your lender has fully underwritten your loan...you may consider this non-contingent option. 1G. This is your purchase price - total of A through F. 2. Close of escrow terms are dictated by the lender on how many days it will take to complete the sale. 3. Financing terms are dictated by the lender on how many days it will take to complete the loan process. 4. The appraiser is hired by the lender within 24 hours of acceptance and is an independent party to confirm the purchase price for the bank to fund the loan. This timeline is confirmed by the lender and can take between 7-14 days. 5. This confirms the Real Estate Agency relationships for the Seller(s) and the Buyer(s). 8. The seller typically orders the Preliminary Title report in advance and includes it in the disclosure package. We will reach out to the Escrow/Title officer before presenting our offer to confirm the title for this home has no issues - liens, non-conforming units, clouds on title etc. 9B. Confirms which appliances/items are included in the sale. 12. This timeline is for your due diligence to confirm the condition of the property. Even though this is the Buyers responsibility, the Seller in the pursuit of a "clean offer" will pay up to $1400 for inspection reports and include them in the disclosure package. No home is perfect but as long as it is safe, meets most of your needs and wish list...updates & repairs can be made over time. I will help you identify future value, prioritize and plan for future costs. These reports will be taken into consideration with the amount you decide to offer. There are also a few other things we can do before submitting an offer - schedule a short chat with the inspector of record to ask a few questions over the phone, pay half price for the inspector to walk you through the report at the property or you can choose to hire another inspector for a pre-inspection before the offer date. 12B. If you choose to waive your Inspection Contingency timeline and are fully satisfied with the condition of the home, then you initial here. This means you are accepting the property As-Is and will be "full steam ahead" and ready to close. If you change your mind after removing contingencies and do not complete the sale...the seller can keep your 3% earnest deposit. 19A.& 19B. Are documents in the disclosure package. This is the Sellers opportunity to share information about the property during their ownership. 19C. This is usually called the JCP report. 19F. This is the 3R report. This report confirms the permit history of the home. 20. The Seller is responsible for A. B. & D. 20C. - If an oil tank is discovered on the property it is the owner's responsibility to professionally remediate. The cost for this inspection is $85. If an oil Tank Inspection is not in the disclosure package, it is encouraged for the buyer to order it. 27. This is a courtesy given by the Seller to confirm the condition of the home has not changed since you wrote the offer. This is scheduled 5 days before the sale is completed. This is not a contingency. **This walk-through is scheduled after the staging is removed. 28. This is our house warming gift that covers, lock changes, appliances, electrical, plumbing, washer, dryer & the water heater to name a few. This is for 1 year. Service calls are $75. If an appliance cannot be repaired it will be replaced for no additional charge. Welcome Home :) 35. Mediation of disputes (automatically part of the contract) 36. Arbitration of disputes, most if not all of my attorney clients initial arbitration and make it part of the contract because they say it’s too expensive to go to court in CA. That being said you need to decide what is best for you and how you feel about it. I am not a real estate attorney so I cannot advise you. Additional information on this subject will be provided. 37. There are people who initial this item because it caps the amount that the seller can get from you, if you default after there are no contingencies. You must decide if you want to initial or not since I am not a real estate attorney. There is additional information that will be provided. 41. If you are waiving any contingencies then we would check this box and attach the Contingency Removal doc to the offer. You will notice that all of the items are referenced in the offer and in the disclosure package. We will discuss each contingency item before waiving to make sure. 43. There are no additional Broker fees paid by the Buyer. 47. Wire fraud is real. Before transferring any monies to the title company...Buyers are to call in and speak to the title company representative and confirm wiring instructions. 49. Additional terms are here which include signing off on the entire disclosure package within 1 day and me doing my agent visual inspection (AVID) in 2 days. This is a strategy that demonstrates to the listing agent and seller that we are serious and we will work towards making this a seamless transaction to complete the sale. If you change your mind and do not complete the sale...the seller can keep your initial deposit. Attached – Possible Representation for Buyers and Seller in case there are multiple offers. How to Hold Title...
Your type of ownership taken, also known as 'vesting of title' will dictate how you sign your closing papers and record the transaction. Here's a great informational brochure explaining the common ways to hold title in California.
What is Title Insurance...
Your policy is issued after the closing of your new home, for a one-time nominal fee, and is good for as long as you own the property.
Buyer's closing cost estimate...
This is an example of a closing cost estimate based on a purchase price of $1.5m. The last week of the transaction is when everything comes together - the Closing Document (with a 3 day clock) is emailed, the loan docs are signed in person with a mobile notary, your remaining down payment balance is due and wired to the title company, the lender funds the loan and the deed is recorded in your name. Typically recorded by 3pm and the keys in your hand by 4pm...Congratulations & Welcome Home! We DID IT!!!
