Understanding Earnest Money

🔍 What is Earnest Money? Earnest Money acts like a security deposit in real estate transactions. It's a vital sign of commitment to sellers, demonstrating that you're a serious buyer.

Due diligence & the Disclosure package

You've found the perfect home- now what? The next step is receiving the disclosure package so you can begin due diligence.

State and city laws require specific seller disclosures to be part of every property transfer. All of them are important to read, although many of them are generic advisories used state-wide for all types of listings. Sellers provide their knowledge of the property by filling out a Transfer Disclosure Statement and other supporting forms; they may also choose to provide various inspections, such as a pest/termite inspection or a home inspection.

It's my job to help guide you through the seller disclosures and to advise you on how to do your due diligence. Here's the table contents for what you should expect to see in a standard disclosure package for a single family home.

Closing on Your Home

Once your offer is accepted, the home closing process begins. Here are the typical steps involved:

As a note, closing costs can typically make up about 3 – 6% of the loan amount.

Escrow / the In-Contract process is normally opened/started within one business day of acceptance of the purchase agreement. At this time, your initial deposit, as specified in the contract, is deposited into the escrow account/to the earnest money deposit holder. The duration of the escrow/in-contract period—from offer acceptance to recordation of the transfer of ownership—is usually 21 to 45 days, though all-cash purchases will sometimes close more quickly.

‌

What do Closing Costs Include?

The term 'closing costs' basically means how much it costs a buyer to do the deal. Bulked into this term are: lender fees, escrow fees, title insurance, pro-rated property taxes, homeowner's insurance, and pro-rated HOA dues (if applicable).

Here's an example of what an Estimated Buyer's Settlement Statement looks like. Of course, each estimate is different based on the property details, downpayment amount, and month of close (for tax pro-ration purposes). Upon acceptance, you put your deposit into escrow, and then just before the close date, you'll need to come up with the remaining funds, which includes the balance of your downpayment and all of the fees. I explain all of this as we go.

And here's some good news: buyers typically don't pay any commission for agent representation - that's usually a seller fee.

Understanding the Purchase Agreement

When the time comes, I'll guide you through the purchase agreement and advise you on writing the winning offer.

Here's a sample of the Purchase Agreement so you can familiarize yourself before writing offers.

Navigating the Future of Real Estate Commissions and How it Affects You

The NAR Settlement addresses allegations of anti-competitive behavior in real estate broker commissions, with NAR and major real estate companies agreeing to pay $418 million to settle the claims and implement changes in commission rules. Sellers may see more transparent and negotiable commission structures, potentially giving them more control over payments to listing and buyer agents, though the total fees paid by sellers may remain similar. Buyer agents may now be compensated directly by buyers, or sellers may cover their fees. These changes aim to increase transparency and marketability for sellers while requiring buyers to sign agreements detailing their agent's compensation. Practices will evolve based on market conditions.
