HOA AND CDD DEFINED

‌
Image

WHAT IS AN HOA?

An HOA is a Homeowners Association. It is the group that manages and enforces the rules for a neighborhood or condo community. When you buy in that community, you agree to follow the HOA rules and pay HOA fees.

Benefits

  • Helps protect property values by keeping the neighborhood maintained and consistent
  • Maintains shared areas like pools, gyms, gates, landscaping, walking trails, roofs on condos, and common lighting
  • Can make life easier because some exterior maintenance may be included, especially in condos or townhomes
  • Creates standards that can reduce eyesores like junk cars, overgrown yards, or extreme paint colors

Negatives

  • Monthly or annual fees that can go up over time, plus special assessments for big repairs
  • Rules can feel strict and limit what you can do with your property such as parking, fencing, rentals, or exterior changes
  • Enforcement can be annoying if the HOA is overly aggressive or inconsistent
  • Poorly managed HOAs can create problems like deferred maintenance, higher costs, or resale challenges

Bottom line

HOAs can be a big plus if you want a well kept community and amenities. They can be a headache if you value freedom and hate being told what to do with your own house.

WHAT IS CDD?

In Northeast Florida, a CDD is a Community Development District fee. It helps pay for the neighborhood’s infrastructure and long term upkeep, things like roads, drainage, amenities, landscaping, and common area maintenance.

A CDD has two parts. The first is the bond or debt portion, which is the repayment for building the community improvements. The second is the maintenance portion, which covers ongoing operating costs to keep everything looking good and functioning properly. You pay CDD fees once a year as part of your property tax bill, due in January.

CDD amounts can vary even within the same neighborhood. Homes built earlier or later can be in different phases with different debt schedules. Maintenance costs can rise over time as the community ages and service costs increase. In many districts, your lot size or the way the district calculates assessments can also impact what you pay.

In some cases, the debt portion can be paid off early, which may lower your annual CDD bill going forward. But if you are not planning to stay in the home long, paying it off may not benefit you, because you might not be there long enough to recoup the payoff amount. Check with the county to see if early payoff is allowed for that specific home and what the payoff figure would be.

One more thing buyers miss: communities with no CDD often make up for it with a higher HOA fee, because the HOA still has to fund amenities and maintenance somehow.

If you are coming from California, think of a CDD as very similar to a Mello Roos assessment.

CLOSING ON YOUR HOME

After your offer is accepted, the process of closing on the home starts. Here are the usual steps:

- It's important to note that closing costs often range from 3 to 6% of the loan amount.

- Typically, the process begins within one business day after the purchase agreement is accepted. Your initial deposit, as outlined in the contract, is then placed into a designated account. The period from the acceptance of the offer to the recording of the ownership transfer generally lasts between 21 to 45 days, though purchases made entirely in cash may close faster.

HOW WE WORK TOGETHER

‌
Image

UNDERSTANDING THE NAR LAWSUIT

The NAR Settlement addresses allegations of anti-competitive behavior in real estate broker commissions, with NAR and major real estate companies agreeing to pay $418 million to settle the claims and implement changes in commission rules. Sellers may see more transparent and negotiable commission structures, potentially giving them more control over payments to listing and buyer agents, though the total fees paid by sellers may remain similar. Buyer agents may now be compensated directly by buyers, or sellers may cover their fees. These changes aim to increase transparency and marketability for sellers while requiring buyers to sign agreements detailing their agent's compensation. Practices will evolve based on market conditions.

‌
Image

UNDERSTANDING HOW AGENTS ARE COMPENSATED

In the past, the buyer agent was in most cases paid through sharing the commission the listing agent negotiated with the seller. This is now changing due to the NAR Settlement and my commission and fee could be paid in multiple ways which I will discuss with you when we meet.

‌
Image

UNDERSTANDING BUYER REPRESENTATION

We will provide you with a Buyer Agency Agreement that will explain in detail the role of your Buyer Agent. This must be signed by the purchaser and the broker in order for the Agent to represent the purchaser on a buyer-side of a transaction. A Buyer Agent represents only the buyer and promotes and protects your best interests as your fiduciary.
